06.4 HIV Public Health Notification Requirements in Queensland
06.4.1 Responsibility for notification
Medical practitioners are required to notify the chief executive of a clinical HIV diagnosis unless the examination was carried out in a hospital, in which case the person in charge of the hospital is responsible for notification (unless the person in charge has a reasonable excuse not to make the notification) (Public Health Act 2005 (Qld), ss 70 (opens in a new window) and 71 (opens in a new window)).
In the above circumstances, the notice to the chief executive must comply with the requirements defined by regulations, be in approved form and, if applicable, include the name of the medical practitioner who referred the person’s specimen for pathological examination (ss 70(2), 71(2)), 72(2) and 73(2)). 06.4.2 Mode of notification
Notifications to the chief executive may be given using an anonymity code (Public Health Act 2005 (Qld) s 74 (opens in a new window)).
