Responsibility for notification #
A medical practitioner or pathology service must notify the chief executive of a suspected case of HIV or death resulting from HIV (or another notifiable condition) within 3 days of that suspicion having been formed (South Australian Public Health Act 2011 (SA) s 64 and South Australian Public Health (Notifiable and Controlled Notifiable Conditions) Regulations 2012 (SA) regs 4 and 5). The maximum penalty for failing to comply with s 64 is $10,000.
Mode of notification #
The South Australian Public Health Act 2011 (SA) requires reports to be made in a manner and form determined by the chief public health officer (s 64(2)(a)). The Act has extensive confidentiality provisions at ss 99 and 100. SA Health requires HIV to be reported through telephone notification.
